Graphic pictures on tobacco packaging violate the U.S. constitution.
A hearing held in the U.S. Court of Appeals in Washington D.C. upheld an appeal by tobacco companies that the graphic pictures violate the tobacco companies’ right to free speech under the First Amendment.
The FDA ‘failed to present any data ’ showing that the proposed graphic warnings ‘will accomplish the agency’s stated objective of reducing smoking rates ‘ U.S. Circuit Judge Janice Rogers Brown wrote in her majority opinion.
