US District Judge Richard Leon ruled on Wednesday that the Food and Drug Administration’s demand for pictorial warnings on cigarette packs violates First Amendment rights to free commercial speech.
Judge Leon said the images were:
neither designed to protect the consumer from confusion or deception, nor to increase consumer awareness of smoking risks; rather, they were crafted to evoke a strong emotional response …
The government is expected to appeal the ruling.
